11/20/1992 RL: PLEADING: REQUEST FOR 30 DAYS IN WHICH TO FILE AN AMENDMENT. rgraser 9/20/00: Attorney Letter Dated Received September 18, 2000, (Re: DTV Application, Station KVAW (TV), Eagle Pass, Texas). On behalf of Hispanic Television Network, Inc. ("HTVN"), the proposed assignee of full-power television Station KVAW (TV), Eagle Pass, Texas (Facility ID #32621) (the "Station"), we are writing in response to your letter of August 23, 2000 to Juan Wheeler, Jr., licensee of the Station. Your letter advised Mr. Wheeler of his failure to file with the Federal Communications Commission ("FCC" or "Commission") a timely DTV application for the Station. Although HTVN currently is not the licensee of record for the Station, a dispute regarding ownership of the Station has been resolved in state and federal courts in favor of HTVN, and an application currently is pending with the Commission to assign the Station's license from Mr. Wheeler to HTVN. See FCC File No. BALCT-20000825AHI. The details of the Station ownership dispute were summarized in a letter to the Commission, dated July 21, 2000, regarding the Station's temporary discontinuance of operation and also in a narrative exhibit attached to the assignment application filed on August 25, 2000. A copy of the July 21, 2000, letter is enclosed for your review and information. Because HTVN ultimately will be the licensee of the Station once the pending assignment application is granted and the underlying transaction is consummated, we felt it was appropriate to respond to your letter to Mr. Wheeler regarding the Station's DTV application. HTVN has been unable to locate Mr. Wheeler and has reason to believe that Mr. Wheeler has left the country. Consequently, HTVN cannot adequately explain Mr. Wheeler's failure to file the required DTV application. Nevertheless, as the proposed assignee if the Station, HTVN intends to file imminently an application for DTV authority that will be contingent upon FCC approval of the assignment application and consummation of the underlying transaction.
