Section 1: FCC Form 312EZ Qualification Questions

Overview

The qualification questions determine, for the most part, your eligibility for filing an EZ.  Most questions can be answered with a Yes or No answer – by clicking on the Yes or No displayed at the bottom of each question. A link to all questions is provided on the right side of your screen, under Summary. It is recommended that you answer the questions in the order presented by clicking on Next.  Each time you click on Next, the system automatically saves all answers entered up to that point.  (Note that this auto save feature only applies to the questionnaire portion of Form 312EZ, not to the technical portion.)  Once saved, you may exit the EZ form at any time throughout the filing process.  Based on your answers, the system will either move you forward in the EZ filing process or display a message stating that you do not qualify for the EZ

If you do not qualify for the EZ, you will be given three options:

  1. File a Full Form 312

  2. Review your answer to this question, OR
  3. Exit from this application

If you wish to return to a previous question, click on the Previous radio button or click on the appropriate question from the list found on the right-hand side of the page. Once you have successfully answered all questions, you will have completed the questionnaire portion of the EZ process.

Click on Continue (displayed at the bottom of the last question) to proceed to the ‘Transition’ screen that presents two additional technical requirements for you to consider before your earth station is fully qualified to move to Section 2: FCC Form 312EZ Technical Summary.    They are:  1) Antenna Elevation angle must be between 5 degrees and 90 degrees, and 2) Emission Designator must not include N0N.  Based on your responses, you may move to the Technical Section by clicking on Continue, Cancel and Return to Workspace, or go the Form 312 (main form) by clicking on File a Long Form 312.

Please take a moment to review some special instructions for the following qualification questions.

Question 2 “Will your proposed earth station be a fixed earth station or a  temporary-fixed earth station (not part of a VSAT network) that will operate only in the Fixed Satellite Service?”  If you select Fixed or Temporary Fixed Earth Station to this question, the Nature of Service section of the EZ Technical Schedule will be prefilled with “Fixed Satellite Service.”  Additionally, if you select Fixed Earth Station, the Class of Earth Station section of the EZ Technical Schedule will be prefilled with Fixed Earth Station.  If you select Temporary Fixed Earth Station to this question, the Class of Earth Station section of the EZ Technical Schedule will be prefilled with Temporary Fixed Earth Station, and the system will skip Question 4.   

Question 3 “Which band will your proposed earth station be operating in?”  If you answer C-band, the Frequency Band section of the EZ Technical Schedule will be prefilled with C Band, and you will be required to attach a Frequency Coordination Report in Question 4.  If you answer Ku-band, the Frequency Band section of the EZ Technical Schedule will be prefilled with Ku Band, and the system will skip the next question and proceed to the Type of Station question.  If you answer Other, you will be given the option of:  Going to a 312 Main Form, Reviewing your previous answer to the question, or Exiting the application.

Question 4 “Have you completed a  Frequency Coordination and will you be attaching a Frequency Coordination Report to this application?”  If you answered Yes to this question, you will be prompted to attach a Frequency Coordination Report, but will not be required to attach the report at this time.  (The Frequency Coordination Report must not be older than six months of the date of this filing.)

Question 5 “Will you operate your proposed earth station ONLY with U.S. Licensed or Permitted List  (http://www.fcc.gov/ib/sd/se/permitted.html) geostationary satellites (within the parameters specified on the Permitted List?)”  If you answered Yes to this question, the Points of Communication on the EZ Technical Schedule will be prefilled with “Permitted List” And the Satellite Orbit Type section will be prefilled with GSO.

Question 9 “Can you certify that FAA notification is not required under 47 CFR Part 17 and 47 CFR Section 25.113(c)?”  If you answered No to this question, you will be allowed to proceed to the next Question (FCC question).  If you answered Yes, the system will skip the next question (FCC question) and proceed to the Environmental Policy question.

Question 10 Is your Antenna Structure registered with the FCC?”    If you answered Yes, the system will require that you enter an ASR number in the EZ Technical Schedule.  If you answered No to this question, you will be given the option of:  Filing a Full Form 312, Reviewing your previous answer to the question, or Exiting the application.  (The Commission assigns painting and/or lighting requirements based on the FAA’s recommendation as to what painting and/or lighting (if any) is necessary to promote air safety.  Report and Order, 11 FCC Record at 4275 ¶ 5.  The Commission has adopted procedures for the registration of antenna structures that are consistent with the FAA’s procedures, by which antenna structure owners must provide the FAA with notification of any proposed construction or alteration.)

Question 12 “Are you asking  for a transmit only, transmit/receive, or a receive only earth station?”  If you answered transmit only or transmit/receive to this question, and answered C-band or Ku-band to Question 3, the system will prefill the Type of Earth Station Facility section in the EZ Technical Schedule with either Transmit Only or Transmit/Receive, and the Filing Classification section of the EZ Technical Schedule with Application for License of New Station in the EZ Technical Schedule.  If you answered receive only to this question, and answered C-band to Question 3, the system will prefill the Type of Earth Station Facility section of the EZ Technical Schedule with Receive Only and the Filing Classification section of the EZ Technical Schedule with Application for Registration of New Station.  If you answered receive only to this question, and answered Ku-band to Question 3, you will be given the option of:  Filing a Full Form 312, Reviewing your previous answer to the question, or Exiting the application.   

Question 13 “Has a Radiation Hazard Study (refer to OET Bulletin 65) been completed and will this Radiation Hazard Study be attached as an exhibit to this application?”  If you answered Yes to this question, you will be prompted to attach a Radiation Hazard Study, but will not be required to attach the study at this time.

 If after the last qualification question (#23), the filing appears to qualify for 312EZ processing, a  transition screen displays advising the filer of two additional qualifiers yet to appear on the Schedule B that could affect their EZ eligibility.  They are: 

  1. Antenna Elevation angle must be between 5 degrees and 90 degrees.

  2. Emission Designator must not include N0N.
