Section 1.1306 (i.e., The facility will not have a significant environmental impact and complies with the maximum permissible radiofrequency electromagnetic exposure limits for controlled and uncontrolled environments). Unless the applicant can determine compliance through the use of the RF worksheets in Appendix A, an Exhibit is required.

STA REQUEST

THE LICENSEE OF WBVA RESPECTFULLY REQUESTS THE EXPEDITED APPROVAL OF THIS STA REQUEST.   THE LICENSEE'S LOCAL ENGINEER, TERRY SUGGS, IS PREPARED TO IMMEDIATELY PLACE THE STATION BACK ON THE AIR WITH THE TEMPORARY SYSTEM THAT THE FCC STAFF HAS APPROVED IN THE PAST. THIS LICENSE WILL BE CANCELLED ON THE STATION DOES NOT RETURN TO THE AIR BY MARCH 25, 2017.

THE STA PROPOSED OPERATIONAL INFORMATION IS AS FOLLOWS:

1. GEOGRAPHIC COORDINATES 36 51' 15' N, 76 10' 17' W (NAD 1927).
2. FREQUENCY 1450 KHZ
3. HOURS OF OPERATION UNLIMITED OPERATING POWER
4. POWER 0.03 KW DAYTIME, 0.03 KW NIGHTTIME
5. ANTENNA TYPE TEMPORARY VERTICAL RADIATOR
6. OVERALL HEIGHT 12 METERS

AS PREVIOUSLY NOTED TO THE FCC STAFF, THE LICENSEE HAS BEEN STRUGGLING AND REGRETTABLY CONTINUES TO STRUGGLE WITH LOCAL ZONING TO OBTAIN APPROVAL FOR A SHORT TOWER FOR DIPLEX USE OF WBVA AND THE CO-OWNED STATION WVAB (AM), VIRGINIA BEACH, VIRGINIA.
THE LICENSEE RECOGNIZES THAT THERE HAVE BEEN SEVERAL STA ISSUED FOR THIS STATION AND WVAB OVER THE PAST FEW YEARS. THE LICENSEE HAS NOT BEEN SITTING ON HIS HANDS IN THIS MATTER BUT RATHER HAS SPENT TENS OF THOUSANDS OF DOLLARS ON ENGINEERING AND LEGAL FEES TO OBTAIN A PERMANENT HOME FOR WBVA AND WVAB, BUT THESE CONTINUED ZONING PROBLEMS HAVE BEEN A COMPLETE NIGHTMARE.

UNDER THE CIRCUMSTANCES, THE LICENSEE RESPECTFULLY REQUESTS A GRANT OF THIS STA FOR A PERIOD OF 180 DAYS.
